These terms govern your use of MerchPush. By designing merch, uploading a design, or saving it to an account, you agree to them.
Item prices are fixed and shown to you while you design and before you save a merch drop. Delivery costs are not fixed: shipping and handling depend on each recipient's destination and are passed through to you at cost. Because recipients provide their own delivery address when they claim, the final amount of each order is only known at that moment.
By saving a merch drop and adding a payment method, you authorize us to charge that payment method automatically, per recipient order, at the moment the recipient claims their merch. Each charge consists of (a) the item prices shown when you designed the drop, and (b) the actual shipping and handling for that recipient's destination, which may include destination-dependent fulfillment charges such as carrier rates and import or sales taxes our fulfillment partners are required to charge us. Every charge is itemized per recipient on your invoice.
You control your total exposure: your drop's distribution rules cap what each recipient can order, only people you invite can claim, and you can archive a drop at any time to stop further claims and charges. Prices may be displayed in other currencies for convenience; billing is in US dollars.
Merch is produced on demand once a recipient claims it. An order can no longer be cancelled once production has started. If an item arrives damaged, defective, or materially different from the approved design, contact us within 30 days of delivery and we will reprint or refund it. We cannot accept returns for sizing chosen by the recipient.
You are responsible for everything you upload. You represent that you own or are licensed to use every design you submit, and that it does not infringe any third party's intellectual property, publicity, or other rights, and does not violate any law.
You agree to indemnify, defend, and hold harmless MerchPush and its partners from any claim, demand, loss, or expense (including reasonable legal fees) arising out of a design you submit, including any allegation that it infringes another party's rights.
Every design is subject to our review. We may decline, pause, or remove any design or merch at any time, with or without notice, and without liability to you.
MerchPush is provided "as is." To the fullest extent permitted by law, we are not liable for indirect or consequential damages arising from your use of the service.
